AGREEMENT BETWEEN YOU AND WEBKA.TRAINING
1. USE OF THE WEBSITE Last Updated Date: February 22th, 2017

These rules define the terms of use by the user (user, you) materials and services www.webka.training site and its sub-sections (the "Website"). The use of materials and services of the Website is governed by the norms of the Russian legislation.

These rules are a public offer. Getting access to the web site user is considered acceding to this Regulation, therefore carefully read these rules before starting to use the site.

If you do not agree with all of the following terms, don`t use the Website. Since use of the Site, you acknowledge that you are the legal capacity of a person, have the right to make rules, to use the site, to carry out legal actions.
Webka.Training provides automatic updates and other resources available through the Website (collectively, the "Services") to you on these terms. Unless otherwise indicated, the Rules govern your use of any new features that augment or enhance the current Service, including the release of new Webka resources. Webka.Training may at any time unilaterally amend these Rules. Such modifications shall be effective immediately upon posting the new version of the Rules on the website. If user does not consent to such modifications it shall refuse access to the Website, terminate the use of materials and services. We recommend that from time to time to browse this section for information on any such changes.

1. USE OF THE WEBSITE
The User agrees to use the Website only for purposes that do not contradict the current legislation of Russian Federation and norms of international law and the principles of morality, rationality and morality, and agrees not to take actions that lead or may lead to malfunction of the Website and its services.

The use of this Website and the materials contained in it are allowed only for private, non-commercial purposes.
The use of press releases and other documents classified as public is permitted provided that the source of information (paragraph 1 of Part 1 of Article 1274 of the Civil Code). You may not modify the content of the website, do not have the right to distribute and publish content for commercial purposes.

Using the Service or submitting material to any of the servers, for example, by e-mail or through the Website, you agree that (A) the material will not contain any item that is unlawful or otherwise unfit for publication; (B) you will use reasonable efforts to scan for viruses and remove any viruses or other contaminating or destructive features before submitting any material; (C) you own the material or have the unlimited right to provide it to us, and Webka.training may publish the material free of charge and (or) to include it or any concepts described in it in its products without incurring any liability or liabilities; (D) you agree not to bring any legal action against Webka in connection with the submitted materials by you to us, as well as loose Webka.Training from liability in the case of excitation of the claim by any third party in connection with any materials provided by you to Webka.
The Company may at any time remove any materials in its sole discretion intended users.

You agree that Webka has the right at its sole discretion without prior notice deny your use of the Services or access to the Website, if the company becomes aware of a violation of the Terms or other agreements that may be associated with your use of the Website.
With regard to users who do not comply with the terms of this Regulation, Webka.Training reserves the absolute right to suspend access to the Website and / or services for a specified period or in full. The choice of interventions is the exclusive prerogative of the company. Notice of violation the rights of users are not sent.

2. REGISTRATION
In order to access certain features of the Instructure Properties you must create an account (“ACCOUNT”). Certain features are only available to Instructor Accounts. 2.1 Registration data. In registering for the Services, you agree to (1) provide true, current, and complete Registration Data; and (2) maintain and promptly update the Registration Data to keep it true, current, and complete. You are responsible for all activities that occur under your Account. You may not share your Account or password with anyone, and you agree to notify Instructure immediately of any unauthorized use of your password or any other breach of security. You agree not to create or access an Account using a false identity or information, or on behalf of someone other than yourself. You agree that you shall not have more than one Account at any given time. You agree not to create an Account or use the Instructure Properties if you have been previously removed by Instructure, or if you have been previously banned from any of the Webka Properties.

4. RESPONSIBILITY FOR CONTENT.
4.1 Types of content .You acknowledge that all Content, including the Webka Properties, is the sole responsibility of the party from whom such Content originated. This means that you, and not Instructure, are entirely responsible for all Content that you upload, post, e-mail, transmit or otherwise make available (“MAKE AVAILABLE”) through the Webka Properties (“YOUR CONTENT”). Other Users of the Webka Properties, and not Webka, are similarly responsible for all Content such other Users Make Available through the Webka Properties (“USER CONTENT”).
4.2 No obligation to pre-screen content. You acknowledge that Webka has no obligation to pre-screen Content (including, but not limited to, Your Content and User Content), although Instructure reserves the right in its sole discretion to pre-screen, refuse, or remove any Content that (1) violates any law or regulation, (2) violates these Terms, including the User Code of Conduct set forth in Section 5.4 hereof, and/or (3) otherwise creates liability for Webka.

5. OWNERSHIP
5.1 Webka Properties. Except with respect to Your Content and User Content, you agree that Instructure and its suppliers own all rights, title and interest in the Webka Properties. Webka’s name and other related graphics, logos, service marks and trade names used on or in connection with the Webka Properties are the trademarks of Webka and may not be used without permission in connection with any third-party products or services. Other trademarks, service marks and trade names that may appear on or in the Webka Properties are the property of their respective owners.
5.2 Your content. Your Content shall at all times remain your sole property and you agree that you have no right, title or interest in or to any other Content that appears on or in the Webka Properties. You represent that you have all necessary right, power and authority to post Your Content to the Webka Properties. You agree to allow Webka and its applicable contractors to freely host, reproduce, transmit, modify, display and otherwise use Your Content (in whole or in part) as reasonably necessary to provide the Services to you, and in accordance with Instructure’s agreement with your Entity, if applicable.
5.3 Your account. Notwithstanding anything contained herein to the contrary, by submitting Your Content to any forums, comments or any other area on or in the Webka Properties, you hereby expressly permit Webka to identify you by your username as the contributor of Your Content in any publication in any form, media, or technology now known or later developed in connection with Your Content.
5.4 User Code of conduct. As a condition of use, you agree not to use the Webka Properties for any purpose that is prohibited by the Terms or by applicable law. Do not post, or permit others to post, content on the Webka Properties or on your profile that (i) encourages illegal activities, is fraudulent, or is unlawful; (ii) insults, defames, harasses, or threatens others; (iii) violates the copyright or intellectual property or privacy rights of others; (iv) contains obscene, vulgar, pornographic, or libelous material; (v) harms or impersonates others, including other Users; or (vi) advertises or sells a product or service. Do not reproduce content from your Course or other Learners unless allowed by the express copyright terms laid out by the Instructor. Do not share the solutions to assignments with others unless this is expressly authorized by the Instructor. Do not submit the work of others as your own work. Respect the privacy of other Users. Respect the diversity of opinions and cultures that will be presented by other Users. Do not attempt or engage in, any potentially harmful acts that are directed against the Webka Properties, including but not limited to violating or attempting to violate any security features of the Webka Properties, introducing viruses, worms, or similar harmful code into the Webka Properties, or interfering or attempting to interfere with use of the Webka Properties by any other user, host or network, including by means of overloading, “flooding,” “spamming,” “mail bombing,” or “crashing” the Webka Properties. If you believe that someone has violated this code of conduct, begin by notifying the Instructor of the Course. If the issue is not addressed by the Instructor to your satisfaction, contact conduct@webka.training with your concerns.

6. FEEDBACK
You agree that submission of any ideas, suggestions, documents, and/or proposals to Webka through its suggestion, feedback, wiki, forum or similar pages (“FEEDBACK”) is at your own risk and that Webka has no obligations (including without limitation obligations of confidentiality) with respect to such Feedback. You represent and warrant that you have all rights necessary to submit the Feedback. You hereby grant to Instructure a fully paid, royalty-free, perpetual, irrevocable, worldwide, non-exclusive, and fully sublicensable right and license to use, reproduce, perform, display, distribute, adapt, modify, re-format, create derivative works of, and otherwise commercially or non-commercially exploit in any manner, any and all Feedback, and to sublicense the foregoing rights, in connection with the operation and maintenance of the Webka Properties.

7. TRADEMARKS
«Webka.Training» is a registered trademark, including the Russian Federation. #WebkaLMS, #Webkaskills included in the proposed service structure logo are trademarks or registered trademarks of Webka.Training in the Russian Federation and / or other countries. Flash is a registered trademark of Adobe Systems, Inc. in the US and / or other countries. Other names of products and companies mentioned on the Website may be trademarks or registered trademarks of their respective owners. Your access to the Web should not be regarded as a site to provide (in any specified way) any license or right to use any marks listed on the Web site, without the prior written consent of Webka or a third person who is the owner of such Marks.
